1. Scope and Acceptance
These Terms of Service (“Terms”) govern your use of the Sullivan Dermatology website and the online features and SMS program that reference these Terms. The website and program are operated by Tory Sullivan MD PA d/b/a Sullivan Dermatology (“Sullivan Dermatology,” “we,” “us,” or “our”).
Please read these Terms before using our website. By using the website after being provided notice of these Terms, you agree to the website-use provisions to the extent permitted by law. We will obtain separate affirmative agreement when required.
Using our website or accepting these Terms does not, by itself, enroll you in text messaging, authorize marketing, or constitute consent to medical treatment. Clinical services, financial arrangements, and research participation may require separate agreements or consent documents.
2. Medical Information and Patient Care
Our website provides general information about dermatology, medical and cosmetic services, and related topics. This information is educational and is not a substitute for an individualized evaluation, diagnosis, or treatment plan from a qualified healthcare professional.
Browsing our website, submitting a general inquiry, or requesting an appointment does not, by itself, establish a provider–patient relationship. These Terms do not change an existing clinical relationship or the professional obligations associated with it.
Treatment recommendations and eligibility depend on an appropriate clinical evaluation. Descriptions, photographs, testimonials, and examples of outcomes do not guarantee a particular result. Individual results and treatment needs vary.
Do not use website forms, email, or text messaging for medical emergencies. Call 911 or seek emergency care when appropriate. Electronic messages are not continuously monitored. For time-sensitive, non-emergency concerns, call our office.
3. Appointments, Fees, and Financial Policies
An online appointment request is not confirmed until you receive confirmation from our office or scheduling system. Contact us promptly to cancel or reschedule an appointment.
Fees, insurance responsibilities, deposits, cancellation charges, and refund conditions are governed by the applicable financial policies or service agreements disclosed to you. These website Terms do not create additional charges or replace those agreements.
Website pricing and offers are subject to their stated conditions and confirmation before purchase or treatment. Insurance participation does not guarantee coverage of a particular service. Any financing arrangement is subject to its separate terms and approval requirements.
4. Information You Provide and Account Access
Provide accurate, current information when communicating with us and notify us when your contact information changes. Submit another person’s information only when you have appropriate authority to do so.
Keep patient-portal credentials and verification codes confidential, and notify us of suspected unauthorized access. Parents, guardians, and other representatives must act within their legal authority. These Terms do not change the rules governing consent to a minor’s care or access to confidential medical information.
5. Acceptable Website Use
Use our website only for lawful purposes. Do not impersonate another person; submit fraudulent information; attempt to access another person’s records; introduce malicious software; circumvent security controls; or interfere with website operation. Unauthorized automated activity that disrupts the website or extracts protected information is prohibited.
We may restrict access to website features when reasonably necessary to address misuse or security concerns. Such restrictions do not eliminate your lawful access to medical records or our obligations concerning patient care.
6. Website Content, Photographs, and Reviews
Website text, graphics, photographs, logos, and other materials are owned by Sullivan Dermatology or used with permission, unless otherwise indicated. You may view or print materials for personal, noncommercial use. Commercial reproduction or distribution requires permission, except where applicable law permits otherwise.
Submitting a photograph, message, or other material to our office does not authorize us to publish it or use it in advertising. We will obtain any separate authorization required for those uses.
Nothing in these Terms prohibits an honest review, a lawful complaint, or another legally protected statement about your experience.
7. Privacy and Electronic Communications
Our Privacy Policy explains how we collect, use, and share information. Protected health information is also governed by our Notice of Privacy Practices and applicable healthcare privacy laws. You may request that Notice from either office.
Ordinary email and SMS may not provide the protections available through a secure patient portal. Avoid sending sensitive medical information, photographs, payment card details, or identification documents through ordinary text or general website forms. Contact us for an appropriate secure method.
These Terms do not waive your privacy rights or authorize disclosures that require separate permission. You may ask our office about alternative communication methods.
8. SMS Terms and Conditions
Program and Message Types
The Sullivan Dermatology SMS program is operated by Tory Sullivan MD PA d/b/a Sullivan Dermatology. When you affirmatively opt in, you agree to receive the categories of text messages described in your consent. Messages may be sent manually or using automated technology.
Patient-service messages may include responses to inquiries; appointment confirmations and reminders; scheduling changes; consultation and registration information; follow-up communications; office updates affecting your appointments; and links to secure forms or patient communications.
Promotional messages, only with separate express written or electronic consent, may include information about Sullivan Dermatology cosmetic services, practice events, and special offers. Consent to appointment or patient-service messages does not enroll you in promotional messaging.
How You Opt In
You may opt in by selecting an optional, unchecked SMS consent box on our online forms or by completing an SMS consent section on a paper form. We maintain records of consent.
You may also give express verbal permission for a specific non-promotional, one-to-one conversation where permitted. We obtain written or electronic consent before enrolling you in recurring informational or promotional messaging. When you text us first, we may respond to your request; that exchange does not automatically enroll you in recurring messages or promotions.
SMS consent is not a condition of treatment, purchase, or payment. Merely providing a phone number, booking an appointment, or accepting these Terms does not constitute consent to recurring texts. You must be the subscriber or an authorized user of the number you provide. Notify us if your number changes or is reassigned.
Message Frequency
Message frequency may vary. Our estimated maximum is up to 6 routine messages per week, including any separately authorized promotional messages. Frequency depends on your appointments, inquiries, and preferences. Additional replies may occur during an active conversation you initiate or request.
Message and Data Rates; Delivery
Message and data rates may apply according to your carrier and mobile plan, including charges for messages sent or received. Contact your carrier for plan details. Delivery depends on your carrier, device, and network availability and is not guaranteed. Carriers are not liable for delayed or undelivered messages.
How You Opt Out
Reply STOP to any Sullivan Dermatology text message to unsubscribe at any time. You may receive one final, non-promotional message confirming your opt-out. We will then stop SMS messages to that number unless you affirmatively opt in again.
We also honor other clear requests to stop texting, including requests made to our office. Opting out does not cancel appointments, change your eligibility for care, or eliminate responsibilities under a separate agreement. We can communicate through other appropriate channels.

SMS Consent and Data Sharing
Mobile Opt in, SMS Consent, and phone numbers collected for SMS communication purposes will not be shared with any third party and affiliates for marketing purposes.
We do not sell or rent SMS consent records or numbers collected for the SMS program. Messaging service providers and carriers may process this information only to deliver and support our messages, maintain consent and opt-out records, or meet legal obligations. They may not use it for their own marketing or lead generation. Your consent applies to Sullivan Dermatology and does not authorize another business or affiliate to market to you.

Message and data rates may apply. Reply STOP to opt out. Reply HELP for assistance. Message frequency may vary; estimated maximum of up to 6 routine messages per week, with additional replies during an active conversation you initiate or request.

9. External Services and Research
Our website may link to patient portals, scheduling systems, payment services, educational resources, or other third-party websites. Their independent activities may be governed by their own terms and privacy notices. A link does not necessarily imply endorsement of all third-party content.
Using a vendor does not eliminate our applicable privacy and security obligations for information handled on our behalf.
Information about clinical studies is provided for awareness and inquiry. Contacting us about research does not enroll you in a study. Participation requires applicable eligibility review and separate informed consent.
10. Website Availability and Limitations
We strive to provide useful, accurate information, but website content may contain errors or become outdated. We may update or temporarily suspend website features for maintenance, security, or other operational reasons.
To the extent permitted by law, public website content and features are provided “as is” and “as available,” without a guarantee of uninterrupted access or error-free operation.
To the extent permitted by law, Sullivan Dermatology is not liable for indirect or consequential damages arising solely from use of the public website. This limitation does not apply to clinical care, medical negligence, privacy or confidentiality obligations, gross negligence, intentional misconduct, or any liability or right that cannot lawfully be limited.
11. Governing Law and Preserved Rights
These website Terms are governed by Florida law and applicable United States federal law, except where mandatory law requires otherwise.
Nothing in these Terms prevents you from contacting a regulator, filing a lawful complaint, or exercising nonwaivable legal rights. These Terms do not require mandatory arbitration or waive a right to a jury trial.
12. Changes and Severability
We may update these Terms and will identify the revised effective date. Changes apply prospectively. We will provide additional notice or obtain affirmative agreement when required. An update does not expand your SMS consent or authorize new message categories without any required new consent.
If a provision is found unenforceable, the remaining provisions remain effective to the extent permitted by law. Separate clinical consent documents and financial agreements govern their specific subjects; these website Terms do not override them.
